Terms of Service for Vessel Venue Hire Agreement

1. DEFINITIONS

For the purposes of this Agreement, the following terms shall have the meanings assigned to them:

The Client: The individual or entity responsible for the charter booking and compliance with these Terms & Conditions.

Guests: Any individuals invited, permitted, or otherwise attending the event on board the vessel, including but not limited to ticket holders, attendees, staff, contractors, performers, and any other persons present during the charter period, whether invited directly by the Client or attending as part of a public event.

Acceptance: The Client accepts the Offer upon payment of the Hire Fee to the Owner.

Activity: The event or function undertaken by the Client at the Venue, as specified in the Special Conditions.

Agreement: This document includes these terms, the Special Conditions, and the Client’s Acceptance of the Offer.

Booking: A confirmed reservation for using the vessel was made by the Client.

Service Commencement Date: The booking date for a 30% non-refundable deposit.

Hire Fee: The total cost of the charter, including the deposit, security bond, and any additional charges.

Security Bond: A refundable $1000 deposit held to cover any damages or breaches of this Agreement.

Special Conditions: Any additional conditions provided in writing by Black Label Cruises.

Vessel: The chartered boat, including its facilities, crew, and equipment.

Vessel Master: The person designated as the captain or skipper of the vessel, holding ultimate authority and responsibility for the safe operation, navigation, and management of the vessel, its crew, and passengers during the charter period. The Vessel Master has the 


Authority to enforce safety regulations and make decisions. 

Regarding the route and activities, take necessary actions to maintain order and safety on board.

2. SERVICE DESCRIPTION

  • Public Event Venue Hire

  • Walk-on Walk-off Venue.

  • Capacity: 200 persons

2.1 Inclusions

The venue hire is for The Vessel “Black Label,” which is owned and operated by Black Label Cruises Pty Ltd. 

  • 1 x Security Staff

  • AV & Sound System: Walk-on, walk-off. Deck sound system, lighting, and an outdoor LED screen

  • Cross-Promotional Marketing Activities: The client is responsible for managing their marketing activities. Cross-promotional activities, Black Label Cruises as a collaborator on Instagram to access this inclusion, in consideration with clause 9.0 Branding and Representation.

  • Swim Stop Option: Optional swim stops are available, Weather and safety permitting, in calm, wind-protected waters.

3. RATES & PAYMENT SCHEDULE

3.1 Vessel Hire

  • Minimum charter duration: 5 hours

  • Rates: As specified at the time of booking

  • Public Holiday surcharge: An Additional 15%

  • Departure Docking Fees: Depending on your preferred departure location, there may be an additional docking fee; this is specified at the time of booking.

3.2 Production & AV

Black Label Cruises Pty Ltd provides production, AV, & Sound in partnership with Cooper Music Services. 

Black Label Cruises accepts no responsibility or liability for any loss, damage, malfunction, or theft of DJ or digital equipment brought on board by the Client or their guests. It is the Client's sole responsibility to ensure that all equipment is securely stored, properly maintained, and adequately protected throughout the duration of the charter.

The Client is also responsible for any damages caused to the vessel, furnishings, or fixtures as a result of the use or installation of such equipment. Any associated repair or replacement costs will be deducted from the Security Bond or charged to the Client.

Black Label Cruises strongly recommends that the Client arrange appropriate insurance coverage for all equipment brought on board.

3.3 Payment Schedule

A non-refundable 30% deposit is required to secure all bookings.

The full hire fee is payable 14 days before the event and will be automatically deducted from the card provided during booking.

3.4 Public Liability Insurance 

For public events where tickets are sold by the Client, the Client is required to provide Black Label Cruises with a Certificate of Currency for Public Liability Insurance, covering a minimum of $20 million.

This insurance must adequately cover any potential claims arising from personal injury, property damage, or loss related to the event.

The Certificate of Currency must be provided to Black Label Cruises no later than 14 days prior to the event date.

Failure to provide the certificate within this timeframe may result in the cancellation of the booking, with no refund of the deposit or hire fee.

The Client acknowledges that Black Label Cruises Pty Ltd will not be held liable for any claims, damages, or losses arising from the Client's event activities, and it is 

3.5 Security Bond

A security bond of $1,000 is required to cover potential expenses; a credit card must be provided when securing the booking, including:  

Damage to the vessel, furnishings, or equipment  

Excessive cleaning beyond standard post-event procedures  

Additional security, legal, or administrative costs  

The security bond will be held against refunds within 7 business days after the event, provided no deductions are necessary.3.6 Docking Fees

The Client is responsible for any docking fees incurred during the hire period, including but not limited to:

Pick-Up and Drop-Off Fees: Fees associated with embarking and disembarking at specified locations.

Additional Docking Fees: Fees incurred if the vessel needs to dock at an alternative or additional location during the charter, whether due to Client requests or unforeseen circumstances.

Late Arrival Fees: Any additional charges incurred as a result of waiting or docking delays caused by the Client or their guests.

Docking fees are outlined in the booking system and are applied where applicable. Any unexpected or additional fees incurred during the charter will be deducted from the Security Bond or charged directly to the Client.

Black Label Cruises will not be liable for any costs associated with changes to docking locations or times requested by the Client or necessitated by safety or operational requirements.


4. CANCELLATION 

4.1 Client Cancellation

  • More than 21 days before the Event: Deposit forfeited, balance refunded.

  • Less than 14 days before the Event: No refund.

4.2 Cancellation by Black Label Cruises (Force Majeure)

A full refund or an alternative booking date will be offered.

4.3 Termination Due to Client’s Breach

No refund will be issued.

Examples of Client Breaches:

  1. Violation of responsible alcohol service requirements.

  2. Causing intentional damage to the vessel or equipment.

  3. Engaging in dangerous or illegal activities on board, such as drug use or excessive intoxication.

  4. Disregarding crew instructions, especially those related to safety and conduct.

  5. Jumping in undesignated areas or being thrown overboard.

5. CLIENT RESPONSIBILITIES & CONDUCT

The Client is responsible for the conduct of all guests during the Event, including ensuring that underage drinking is strictly prohibited.

  • Following all instructions from the Crew and Vessel Master.

  • Ensuring that no guests jump or are thrown overboard.

  • Avoiding the disposal of rubbish or items overboard.

  • Respecting all safety instructions during boarding and while on board.

Immediate termination of the Event will occur if guests exhibit dangerous, antisocial, or threatening behaviour.

Any fines issued by government authorities for misconduct will be charged to the Client.

5.2 Leaving the Vessel & Vessel  Rafting 

Leaving the vessel during the hire period is strictly prohibited, except in the case of a medical emergency or as directed by the Vessel Master. This includes disembarking at any location not pre-approved as part of the charter itinerary.

Rafting up (mooring or tying another vessel alongside) during the hire period is also strictly prohibited unless directed by the Vessel Master for safety reasons.

Any requests for early departure from the chartered route or schedule are at the sole discretion of the Vessel Master, taking into account safety, operational requirements, and the well-being of all passengers and crew.

The Client acknowledges that unauthorised disembarkation or rafting up may result in the immediate termination of the event without refund, and any resulting fines, damages, or liabilities will be the Client's sole responsibility.

The Vessel Master reserves the right to take necessary actions to ensure the safety and security of the vessel and its occupants at all times.

5.3 Late Arrivals Clause

It is the responsibility of the Client and their guests to arrive at the designated departure location on time. Black Label Cruises operates on a strict schedule, and any delays caused by late arrivals may result in a reduction of charter time without any adjustment to the hire fee.

The vessel will depart at the scheduled time as outlined in the booking confirmation, regardless of whether all guests have arrived. If the Client or any guests are late, 

The vessel will not be delayed or rescheduled, and no refund or compensation will be provided for lost time.

In cases where the Vessel Master deems it feasible and safe to accommodate a late arrival after the vessel has departed, any associated costs, including additional docking fees or transport to the vessel, will be at the sole expense of the Client.

Black Label Cruises recommends that all guests arrive at least 30 minutes before the scheduled departure time to ensure timely boarding and avoid disruption to the charter schedule.

6. ALCOHOL & CATERING POLICY

Black Label Cruises Pty Ltd operates as a licensed venue. BYO is strictly prohibited

Strict Prohibition of Drugs: Any passenger found with illegal substances will be reported to WA Water Police for removal from the vessel.

The Crew reserves the right to monitor and limit alcohol consumption as per the Liquor Control Act 1988 (WA).

Any intoxicated guests will be refused service. Failure to comply will result in removal at the nearest jetty.

7. SAFETY & LIABILITY

The Vessel Master has full authority over the vessel, crew, and passengers throughout the charter.

The Safety Management System (SMS) is maintained in compliance with Marine Order 504, including safety drills and risk management procedures.

The Vessel Master may alter the route or activities to ensure safety.

A safety induction will be conducted before departure, and compliance is mandatory.

Guests & The Client are responsible for their belongings, and Black Label Cruises is not liable for lost or damaged property.

The Client acknowledges the inherent risks associated with water travel and releases Black Label Cruises from liability for injuries or damages.

Underpassing Bridge Safety: All passengers on the rooftop must be seated when passing under bridges.

7.1 Smoking and Vaping Policy 

In accordance with the following regulations, the Tobacco Products Control Act 2006, the Medicines and Poisons Act 2014

Work Health and Safety Act 2020 of Western Australia, smoking and vaping are strictly prohibited in all areas of the vessel, including indoor lounges, cabins, restrooms, and any other enclosed spaces.

Smoking and vaping are only permitted in designated outdoor areas as specified by the Vessel Master or Crew. These areas are highlighted in the SAFETY BRIEFING. The Client is responsible for ensuring that all guests comply with this policy.

Any violation of this policy may result in immediate intervention by the Crew or Vessel Master, including the removal of the offending guest(s) from the vessel at the nearest jetty without refund.

The Client will be liable for any fines, penalties, or additional cleaning costs resulting from non-compliance with smoking and vaping regulations.

8. COMPLIANCE

The Client agrees to comply with all applicable laws, regulations, and guidelines relevant to the operation of the vessel and the conduct of the event, including but not limited to:

Liquor Control Act 1988 (WA): Ensuring responsible service and consumption of alcohol.

Marine Safety (Domestic Commercial Vessel) National Law Act 2012 and Marine Order 504: Adhering to safety and operational standards during the charter.

Work Health and Safety Act 2020 (WA): Maintaining a safe environment for all guests, crew, and contractors on board.


Tobacco Products Control Act 2006 and Medicines and Poisons Act 2014: Prohibiting smoking and vaping in enclosed spaces.

9. BRAND IDENTITY & REPRESENTATION 

Black Label Cruises Pty Ltd’s public identity is one of its most valuable assets. Black Label Cruises follows a visual identity outlined in a brand style guide, which ensures consistency and professionalism. This guide 

provides a clear, structured presentation across all channels, protecting brand integrity and supporting effective communication.

The Brand Style Guide and graphic files can be accessed via the footer of the Black Label Cruises website at www.blacklabelcruises.com.au.

All artwork featuring the Black Label Cruises brandmark must receive approval from the Marketing Department before use to ensure consistency and uphold the brand’s premium reputation.

9.1  Use of Images and Media

Black Label Cruises reserves the right to capture and use images and videos taken during the event for promotional purposes.

Guests and clients may share event images on social media, but must credit @blacklabelcruises.

Commercial use of any images featuring the vessel, brand, or crew requires written permission from Black Label Cruises.

10. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Western Australia. Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of Western Australia.
